Intellectual Property Policy

YantrAdhigam Labs Private Limited ("TradeOn") respects intellectual property rights and expects all users of the platform to do the same. This Intellectual Property Policy outlines the procedures for reporting IP infringements and the actions TradeOn may take in response.

1. TradeOn's Intellectual Property

The TradeOn platform — including its name, logos, trademarks, trade dress, software, source code, algorithms, user interface designs, documentation, API specifications, and all original content — is the intellectual property of YantrAdhigam Labs Private Limited, protected under the Copyright Act, 1957, the Trade Marks Act, 1999, the Patents Act, 1970, and other applicable IP laws.

You may not, without prior written authorization from TradeOn:

  • Copy, reproduce, modify, distribute, or create derivative works of the Platform or its content
  • Use TradeOn's trademarks, logos, or trade names in any manner that suggests endorsement or affiliation
  • Reverse engineer, decompile, or disassemble the Platform's software
  • Frame, mirror, or deep-link to any part of the Platform

2. User Content & Licensing

You retain ownership of content you upload to the Platform (product images, descriptions, catalogs, documents). By uploading content, you:

  • Grant TradeOn a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and process the content solely for providing Platform services.
  • Represent and warrant that you own or have the necessary rights, licenses, and permissions to use and authorize TradeOn to use such content.
  • Represent that your content does not infringe upon the intellectual property, privacy, or other rights of any third party.

3. Counterfeit & Infringing Products

Listing counterfeit, pirated, or IP-infringing products on TradeOn is strictly prohibited. This includes:

  • Products bearing trademarks, logos, or brand names without authorization from the rights holder
  • Knock-offs or imitations designed to deceive buyers into believing they are purchasing genuine branded products
  • Products that infringe upon registered patents or design rights
  • Copyrighted content (images, text, software) used without permission
  • Products with misleading or unauthorized certifications (BIS, ISO, FSSAI, etc.)

Sellers are solely responsible for ensuring that all products listed comply with applicable IP laws. TradeOn, as an intermediary, does not pre-verify the authenticity of products listed by sellers.

4. Reporting IP Infringement

If you are an IP rights holder (or authorized agent) and believe that content on TradeOn infringes your intellectual property rights, you may submit a complaint to our designated IP team.

Your complaint must include:

  • Your full name, organization, and contact information
  • A description of the IP right being infringed (trademark registration number, copyright details, patent number, etc.)
  • Identification of the infringing content on TradeOn (product listing URL, seller name, screenshots)
  • A statement that you have a good-faith belief that the use of the material is unauthorized
  • A statement, under penalty of perjury, that the information provided is accurate and that you are the IP rights holder or authorized to act on their behalf
  • Your physical or electronic signature

5. Takedown Procedure

Upon receiving a valid IP infringement complaint, TradeOn will:

  1. Acknowledge the complaint within 36 hours.
  2. Review the complaint for completeness and validity.
  3. Disable access to the infringing content within 36 hours of determination (in accordance with the IT Act, 2000 and Intermediary Guidelines).
  4. Notify the seller whose content has been taken down, providing details of the complaint.
  5. Allow counter-notice: The seller may submit a counter-notice within 10 business days if they believe the takedown was in error.
  6. Restore or permanently remove based on the outcome of the review process.

6. Repeat Infringers

TradeOn maintains a repeat infringer policy:

  • First offense: Content removal + written warning.
  • Second offense: Content removal + temporary account suspension (7-30 days).
  • Third offense: Permanent account termination without refund of subscription fees.

TradeOn may skip warning stages and immediately terminate accounts in cases of egregious or willful infringement.

7. Disclaimer

TradeOn acts as an intermediary platform and does not manufacture, inspect, or guarantee the authenticity of products listed by sellers. While we take IP infringement seriously and act on valid complaints, we do not proactively monitor all listings for IP compliance. Rights holders are encouraged to actively monitor and report infringements.
